Sabyasachi Bandopadhyay : Kolkata,: Despite the claims made by Sagarika Bhattacharya’s father, her two children are required to stay with the brother of her estranged husband for “as long as they are minors”. This is the express condition of the agreement signed by Sagarika and her husband Anurup, which was approved by the Stavanger court, paving the way for the return of Abhigyan (3) and Aishwarya (1) to India. The government of India was witness to the agreement, and the document bears the seal of the Embassy of India in Oslo. Sagarika’s father Manatosh Chakrabarti had said yesterday that “Norwegian law will not be applicable in India” and “we will consult our lawyer on how to get back the children”. The agreement, signed on March 23 at Stavanger by the Bhattacharya couple and Anurup’s brother Arunabhas, and witnessed by P Balachandran, first secretary in the Indian embassy in Oslo, says the children “can return to India to grow up with their paternal uncle as primary caretaker”. The agreement, a copy of which has been accessed by The Indian Express, lays down the responsibilities and obligations of the parents and the primary caretaker, Arunabhas. Anurup and Sagarika agreed that: “Our children Abhigyan Bhattacharya, born 12.10.08 (holder of Indian passport no: H5712616) and Aishwarya Bhattacharya, born 06.12.10 (... passport No: J6681247) are placed in foster care and custody with their paternal uncle Arunabhas Bhattacharya. He will be their foster parent and guardian, and they will live with him as long as they are minors.” The parents affirmed that they were “entering into this agreement out of (their) free will and volition without any coercion or influence”. Today, Sagarika, accompanied by her parents and uncle Debatosh, went to Sinthee, a northern suburb of Kolkata where the children, their paternal grandparents and uncle Arunabhas are staying with a relative. “I was so happy meet my children,” Sagarika said. Ajay Bhattacharya, Anurup’s father, said the children would be taken to Kulti, where he stays with his wife and son Arunabhas, tomorrow.
